MINUTES OF THE MEETING OF THE PLANNING COMMITTEE
HELD ON 10 SEPTEMBER 2007 IN THE PARISH COUNCIL OFFICE, WITTERING WALK.

P07.69 Declarations of Interest. Chichester District Council District Solicitor advised on the following course of action regarding the planning application for Bracklesham Park Community Centre:

The parish council is promoting the scheme either as planning applicant and/or as having an interest in the land. This happens with local authorities from time to time.
There is case law that indicates that the courts will accept that the same councillors may have to consider the same project in their council meetings both as promoter of the scheme and in considering the relevant planning application.
I would advise that a statement should be made at the beginning of the item at your council or planning committee of the interests of the parish council and that the members present will now consider the matter in the planning context only.
When you inform the district council planning office of the response to their consultation I suggest you make clear the position of the parish council.
Your councillors will not have personal or prejudicial interests to declare at your meetings in this matter just because the parish council is the applicant and/or promoter of the scheme.
However, the usual rules on declarations/withdrawal will apply to interests of the councillors e.g. if their home or business is affected by the proposed development

P07.70 Minutes of the last meeting
The advised the Committee of incorrect numbering on the members copies and incorrect venue. The amended minutes of the meeting held on 20 August 2007 were then confirmed as a correct record and signed by the Chairman.

P07.71 Matters Arising from the last meeting None

P07.72 Public Questions. None

P07.73 New Planning Applications.
The Committee had NO OBJECTION to the following applications:
P07.73.1 EWB/07/03769/DOM C Craven And P Monaghan, Werribee 10 Barn Road EW
First floor side extension.
P07.73.2 EWB/07/03775/DOM Mr And Mrs Turner 23 Armada Court East Bracklesham Drive Bracklesham
Single storey garden shed in the rear of an existing dwelling.
P07.73.3 EWB/07/04297/DOM Mr Jonathan Stickland Starfish West Bracklesham Drive Bracklesham. Extension of existing garage.

The Committee had NO OBJECTION but COMMENTED on the following application:
P07.73.4 EWB/07/04264/DOM Mr And Mrs Edwards 10 Charlmead East Wittering
Raise roof ridge and dormers to create two bedrooms and bathroom in roofspace. Demolish garage. Single storey rear extension with mansard roof.
Comment: Concerned about overlooking neighbouring properties.

The Committee deferred the next application to a future public planning meeting to be arranged by the Clerk, details will be displayed in the public noticeboards.
P07.73.5 EWB/07/04273/FUL East Wittering And Bracklesham Parish Council
Land At Eastern End Beech Avenue Bracklesham Bay West Sussex
New community hall with associated extension to existing parking provision and footpaths. New multi-use games area and children’s play area.

P07.74 Enforcement Enquiries - updates
P07.74.1 EWB/05/00265/CONCOM Church Farm Residential Home. Building of perimeter wall. Subsequent planning application was refused. The Local Planning Authority is in negotiation with BUPA Care Services who run the home to agree a scheme of works that would overcome the breach of planning of control. The Committee agreed to submit that anything other than total reinstatement of the original wall is totally unacceptable to the Parish Council.
10.9.07 CDC reported that they are in discussion with BUPA.
P07.74.2 EWB/06/00339/CONHH Green Tiles, 8 Beech Avenue, Bracklesham. Dog breeding query. A report has been prepared for the attention of Head of Service recommending that a notice is served with view to a material change of use at the property. CDC asked for any further information available from the Parish Council. 11.6.07 The Committee received two letters of objection which had been copied to CDC. Clerk was asked to investigate and pass any information to CDC.
10.9.07 CDC reported that an Enforcement Notice will be served. The Clerk was asked to find out when this notice will be served and any timings associated with this notice.
P07.74.3 Stubcroft Farm, Stubcroft Lane, E. Wittering - unauthorised building.
Cllr. Lambert attended the public enquiry on 21 June as representative of the Council and reported that the enquiry had received late paperwork from Mr. Green therefore the Planning Inspector decided to reconvene the enquiry on a date to be arranged in either August/September. The Committee was advised that a new date has been set as 13/14 September. 10.9.07 Mr. Lambert confirmed that he
would attend the public enquiry.
P07.74.4 Stubcroft Farm, Stubcroft Lane, E. Wittering - exceeding permitted number of caravans. The Committee received copies of three letters together with photographs which had been sent to Chichester District Council. The Clerk was asked to contact CDC to obtain an update on the situation and also ask District Councillor Peter Clementson to follow up this enquiry. 10.9.07 CDC reported that an investigation is in progress. 10.9.07 EWB Committee asked what is happening as conditions have not been enforced.
