Notice of a meeting of the Planning Committee to be held on Tuesday 6 May 2008 at 9.30am
in the Parish Council Office, 12 Wittering Walk, East Wittering

6.1 EWB/08/01559/DOM Mr And Mrs Smith Waverney Cottage 38 Coney Six, EW
Extension and alterations to existing house.

6.2 EWB/08/01599/FUL Boots The Chemist 4 Kingfisher Parade EW Installation of internal air conditioning, external air handling unit.

6.3 EWB/08/01619/DOM Mr Roger Upjohn 23 Woodborough Close Bracklesham. Bay window extension to lounge (rear).

6.4 EWB/07/06149/FUL Land adjacent to 76 Stocks Lane, EW. Change of use of existing garages to form 1 no. detached bungalow with single garage. Amended plans.

7. To consider any new planning applications received since the preparation of this Agenda.

8. To receive a report from the Clerk on planning decisions taken by this Committee and Chichester District Council since the last meeting. Copy attached for Members. This will not be read out but a copy is available from the Clerk.

9. Enforcement Enquiries

To receive any further information on the following enforcement enquiries and receive an update on any new enquiries.
1EWB/06/00339/CONHH GreenTiles,8 BeechAvenue, Bracklesham. Dog breeding query. Areport has been prepared for theattention of Head of Service recommending that a notice is servedwith view to amaterial change of use at the property. CDC asked for any further informationavailablefrom the Parish Council.
11.6.07 The Committeereceived two letters of objection which had been copied to CDC. Clerk was asked to investigate and pass anyinformation to CDC.
10.9.07 CDC reported that an Enforcement Notice will beserved. The Clerk was asked to find outwhen this notice will be served and any timings associated with thisnotice.
5.10.07 Enforcement Notice served - compliance is 3 months from when notice takeseffect (29 Oct 07). Therefore compliance date is 29th Jan 08. Individual mayappeal against notice.
18.12.07 AppealNotice received. Committee to write to Planning Inspector objecting to thesuitability of a commercial operation of dog kennels at thislocation.
11.02.08 Awaiting Appeal decision.
03.03.08 Appeal dismissed, awaitingdetails.

2Stubcroft Farm,StubcroftLane, E.Wittering - unauthorisedbuilding.
Cllr. Lambert attended the public enquiry on 21 June asrepresentative of the Council and reported that the enquiry had received latepaperwork from Mr. Green therefore the Planning Inspector decided to reconvenethe enquiry on a date to be arranged in either August/September. The Committee was advised that a new date hasbeen set as 13/14 September.
10.9.07 Mr. Lambert confirmedthat he would attend the public enquiry.
5.10.07 Inquiry held on 13,14 and 20 Sep 07 - awaitingdecision from Planning Inspectorate (anything between 4-10 weeks).
18.12.07 Committee advised that the decision can take up to ayear.
21.1.08 Appealdismissed. Enforcement notice EW/22 upheld, compliance by4.4.08.
03.03.08Awaiting compliance.
14.04.08 Compliance check carried out - building still in situ. Prosecutionprocess commenced for non-compliance with enforcementnotice.

3EWB/07/00366/CONBC Stubcroft Farm,Stubcroft Lane, E.Wittering - exceedingpermitted number of caravans. TheCommittee received copies of three letters together with photographs which hadbeen sent to Chichester District Council. The Clerk was asked to contact CDC to obtain an update on the situationand also ask District Councillor Peter Clementson to follow up thisenquiry.
10.9.07 CDC reported that aninvestigation is in progress.
10.9.07 EWB Committee asked whatis happening as conditions have not been enforced.
5.10.07 Report being submitted toCDC Head of Service for enforcement action.
5.11.07Head of Service directed that a letter be sent to Mr Green stating more than 5caravans have been stationed on the site at certain times. This is a breach ofcondition and is the result of the land being used for the storage of caravansand motor homes. If not removed then enforcement action be pursued. Compliancecheck due this week.
18.12.07 CDC have forwarded areport to the Director of Environment for enforcement action regarding storageof caravans on the land.
21.01.08 Awaiting CDCaction.
11.02.08 CDC drafting a breach ofcondition notice and checking the site to ensure that breach continues prior toserving. The Clerk was asked to write to CDC expressing the committee’sdispleasure and great concern over the time taken to deal with this matter. TheClerk was asked to include the fact that the caravans are being inhabited aslights have been seen at night contravening planning.
03.03.08 Awaiting furtherinformation.
16.04.08 The Committee queriedthe location of the caravans in question as they are in the garden of theproperty and the camping field.

4Land south ofStubcroftPlace,Stubcroft Lane, EW. The Committee agreed to report this landbeing used for storage of vehicles and materials.
18.12.07 CDC have no record ofthis case. Case file will be raised andsite visit will be conducted. Committeedisappointed as e mail sent in November notifying CDC of thismatter.
21.1.08 CDCinvestigating.
11.02.08 CDC awaiting site meeting with responsibleindividuals.
03.03.08 Awaiting furtherinformation.
14.04.08 No land registry orcontact by owners - further investigations as to ownership of landcontinuing.
