HELD ON 22 MARCH 2010 IN THE PARISH COUNCIL OFFICE, WITTERING WALK

P10.26 Declarations of Interest. None.
P10.27 Minutes of the last meeting.
The minutes of the meeting held on 1 March 2010 were confirmed as a correct record and signed by the Chairman.
P10.28 Matters Arising from the last meeting. None.
P10.29 Public Questions. None.
P10.30 New Planning Applications.
The Committee had NO OBJECTION to the following application:
P10.30.1 EWB/10/00712/DOM Mrs J Nutt. 20 Marineside Bracklesham. Proposed balcony to front elevation.
The Committee OBJECTED to the following applications:
P10.30.2 EWB/10/00858/DOM. Mrs H K Fairbairn. Somerswood House 144 Stocks Lane EW. Demolish existing single storey conservatories. Erect single storey side extensions with conservatory wings and new chimney stack.
Objection: The application is confusing – it appears there is no permission for the ‘L’ shape including the chimney and roof lights. The chimney is incongruous and out of keeping.
P10.30.3 EWB/10/00683/DOM Mr Hamilton. 25 Oakfield Avenue EW. Proposed conservatory. Window to side elevation.
Objection: These comments are based on revision B on the website and not the original plan that was sent to the Committee in hard copy. The new window on the side elevation must have obscure glass and be non-opening as it overlooks the neighbour’s property which is not shown on the plan. Obscure glass, non-opening windows must also be on the conservatory adjacent to the neighbour’s on the west. There are also concerns that the conservatory will block out the light and a site visit is requested. If the conditions above are adopted, the Council will remove its objection.

The Committee deferred its decision on the following application for further consideration:
P10.30.4 EWB/10/00827/FUL Mr S Green. Stubcroft Farm Stubcroft Lane EW. Retention and adaptation of building, lowering height by 20% and use of the building as campsite office and reception with ancillary retail sales; 2 no. wc’s; 2 no. disabled wc/showers; and, 5 no. showers.
The Clerk resumed taking the minutes.
P10.31 The Clerk provided an updated list of decisions regarding planning applications.
P10.32 Enforcement Enquiries – updates.
P10.32.1 EWB/04/00367/CONCOM Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised building. (See history in previous minutes).
26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.
22.06.09 Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.
20.07.09 Awaiting outcome of Crown Court hearing on 25.09.09.
28.09.09 District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.
23.11.09 Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.
The appeal was dismissed. If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.
01.03.10 The Applicant is applying to the High Court contesting Appeal decision.
P10.32.2 EWB/08/00100/CONMHC. Westerlies, Bracklesham Lane, Bracklesham. Mobile home in rear garden.
6.05.08 CDC to make site visit.
10.06.08 Site visit carried out and Planning Contravention Notice to be issued.
30.6.08 Awaiting return of PCN.
10.11.08 Compliance check carried out. Consideration now being given to enforcement action on usage of mobile home.
9.02.09 Enforcement Notice awaiting authorisation before issuing.
18.03.09 CDC reported matter is in progress.
26.05.09 CDC has been unable to meet with owner regarding mobile home in garden and building materials in front of Azara Parade. CDC now assessing follow up action.
22.06.09 District Councillor Graeme Barrett to chase the exact position.
6.07.09 Enforcement notice issued
20.07.09 CDC pursuing the matter.
10.08.09 Untidy Land Notice to be issued re. frontage. G. Barrett to provide update at next meeting.
28.09.09 Enforcement notice served to remove caravan and remove building material from front.
23.11.09 a) Mobile home in rear garden – Written representation appeal received against issue of Enforcement Notice – awaiting date of site visit.
01.03.10 Awaiting decision from Planning Inspectorate.
b) Builders material in front of property – Section 215 Notice served – compliance required by 27th Jan 2010
01.03.10 Compliance check found building materials and fence still on site – CDC proceeding with prosecution.
P10.32.3 EWB/09/00157/CONHH. 144 Stocks Lane. Clerk to contact CDC to enquire if the current building work requires planning permission.
22.06.09 CDC issued Stop Notice ceasing all activity effective from 21.06.09 and served Enforcement Notice effective date 29.07.09.
10.08.09 P. Clementson to provide update at next meeting.
28.09.09 Graeme Barrett to check on the progress of this matter.
3.11.09 Graeme Barrett to report to CDC the progression of building works, in particular a new development to the front of the property.
23.11.09 Enforcement Notice appealed against – Hearing set for 08 Dec 09. Appeal against planning application lodged and awaiting date (APP/L3815/D/09/2117544).
12.01.10 Appeal upheld in part. Permission allowed for summer house. Appeal decision to be circulated to the Council.
01.03.10 Compliance date 22.02.10. Planning application to be submitted to retain conservatories. Second storey element to be removed.
P10.32.4 29.06.09 EWB/08/00129/CONHH. Spinnakers, Tamarisk Walk. Enforcement notice issued re change of use of land to the south of the property to use as garden land.
23.11.09 Enforcement Notice appealed against – Public Inquiry set for 09 Feb 10
22.03.10 Appeal allowed and enforcement notice quashed. Case closed.
P10.32.5 Longacre, Bracklesham Lane, Bracklesham. Log business.
12.01.10 Letter sent by CDC to advise of the need to regularise situation.
08.02.10 Clerk asked to write to CDC advising them of a red Citroen for sale outside the property.
01.03.10 Enforcement notices served requiring log business to cease, shed to be removed and car maintenance business to cease.
P10.32.6 Longacre. Bracklesham Lane, Bracklesham. Siting of mobile homes
12.01.10 Letter sent by CDC to advise of the need to regularise situation.
08.02.10 Clerk asked to write to CDC expressing the Council’s concern about the deviation from the planning permission of the siting of the mobile homes.
01.03.10 Breach of condition notice served re drainage and landscaping.
P10.32.7 EWB/09/07501/FUL. Mrs Delia Brazil. The Stables Bracklesham Lane Bracklesham. The use of land for the stationing of caravans for the residential purposes for 1 no. gypsy pitches together with the formation of additional hard standing and utility/ dayroom ancillary to that use as well as the retention of an existing stable block.
22.03.10 Enforcement notice served. Graeme Barrett to investigate siting of letterboxes.
P10.32.8 Land south of 63, Shore Road. District Councillor Graeme Barrett advised that the large container on the seafront at The Old Farmhouse in Shore Road had been reported to CDC.
P10.33 Advisory matters
P10.33.1 The Committee received concerns about the road access at Tide Way. The Committee unanimously agreed that this be moved to the main Council agenda for 8 April.
P10.33.2 EWB/09/05039/DOM Mr E Craig. 4, Plover Close, EW. Loft conversion.
The Committee received information from CDC that there will be an appeal against the refusal of planning permission.
P10.33.3 The Committee received information of a remedial notice served to reduce height of boundary hedge at Park House, Church Farm Lane.
The date and venue of the next meeting of the Planning Committee will be posted on Parish
noticeboards.
