The Committee had NO OBJECTION but commented on the following applications:


P10.69.8. EWB/10/01886/DOM Mrs K. M. Fairbairn Somerswood House 144 Stocks Lane EW

Demolish existing single storey conservatories. Erect single storey rear and side extensions and new chimney stack. Comment: Further to confirmation from CDC that the chimney has been removed from the approved plans the Parish Council withdrew its objection.

Replacement, repositioned detached garage. Comment: This garage is not to be used for living accommodation.


The Committee OBJECTED to the following application:

P10.69.10 EWB/10/02482/FUL Driftwood Homes Ltd Land South Of 78 Stocks Lane EW

2 no. semi detached bungalows and associated works.


The Committee strongly OBJECT to this application for the following reasons:

The 2003 application for one bungalow was refused and the subsequent appeal was dismissed. For this reason two bungalows should also be refused.


The presence of two detached bungalows within the existing garage compound would not be in keeping with the character of the area. The transfer of the existing garage building into a bungalow would result in a building with a character and appearance that is incongruous with the character and appearance of the garage compound. The proposal would have an adverse effect upon the character of the area. This would conflict with the objectives of the relevant development plan policies.


The erection of fencing on the east boundary would be obtrusive to the residents of nos 74 and 76, which currently enjoy the relatively open landscape to the front gardens that was incorporated in the original design of the “estate”.


The lounge windows of the proposed bungalows would be immediately adjacent to the hard standing at the end of the compound. Because of this close relationship, the occupiers of the bungalows would experience an unacceptable amount of noise and disturbance from vehicles travelling along the access way through the compound, vehicles braking, vehicle doors slamming and garage doors being opened and closed.


The proposal would have an adverse effect upon the living conditions of the occupiers of the bungalow with particular reference to noise and disturbance and privacy. This would conflict with the relevant policies of the development plan.


The applicants have drawn attention to PPS3 of the National Policy Guidance, in particular that the proposal would help to satisfy the objective of making more efficient use of land within urban areas to provide new housing.

The applicant has drawn attention to other aspects of the National Policy Guidance, namely PPS3, which states that the more efficient use of land is to take place without compromising the quality of the environment. It can be seen that the proposal would indeed compromise the quality of the environment.


Whilst appreciating that the application will be assessed against the policies of the Development Plan (SE Plan and Local Plan) it must be borne in mind that it is the Government’s intention to abolish the SE Plan.


P10.70 The Clerk provided an updated list of decisions regarding planning applications.


P10.71 Enforcement Enquiries

To receive any further information on the following enforcement enquiries and receive an update on any new enquiries.


P10.71.1 EWB/04/00367/CONCOM Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised building. (See history in previous minutes).

26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.

22.06.09 Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.

20.07.09 Awaiting outcome of Crown Court hearing on 25.09.09.

28.09.09 District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.

23.11.09 Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.

8.02.10 The appeal was dismissed. If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.

01.03.10 The Applicant is applying to the High Court contesting Appeal decision.

P10.71.2 EWB/08/00100/CONMHC. Westerlies, Bracklesham Lane, Bracklesham. Mobile home in rear garden.

6.05.08 CDC to make site visit.

10.06.08 Site visit carried out and Planning Contravention Notice to be issued.

30.6.08 Awaiting return of PCN.

13.10.08 PCN has been returned. The owner stated that the use of the mobile home is ancillary to the use of the dwelling. A requirement to remove fencing was made and a compliance check will be conducted by 23.10.08.

10.11.08 Compliance check carried out. Consideration now being given to enforcement action on usage of mobile home.

9.02.09 Enforcement Notice awaiting authorisation before issuing.

18.03.09 CDC reported matter is in progress.

26.05.09 CDC has been unable to meet with owner regarding mobile home in garden and building materials in front of Azara Parade. CDC now assessing follow up action.

22.06.09 District Councillor Graeme Barrett to ascertain the exact position.

20.07.09 CDC pursuing the matter.

10.08.09 Untidy Land Notice to be issued re. frontage. G. Barrett to provide update at next meeting.

28.09.09 Enforcement notice served to remove caravan and remove building material from front.

23.11.09 a) Mobile home in rear garden – Written representation appeal received against issue of Enforcement Notice – awaiting date of site visit.

b) Builders material in front of property – Enforcement Notice served – compliance required by 27th Jan 2010

01.03.10 Compliance check found building materials and fence still on site – CDC proceeding with prosecution.

13.4.10 – Appeal for mobile home dismissed, enforcement notice upheld. Compliance check due 13.10.10.

12.01.10 Appeal upheld in part. Permission allowed for summer house. Appeal decision to be circulated to the Council.

25.2.10 Planning application received to demolish existing conservatory wings and new chimney stack (10/00858/DOM). Enforcement proceedings suspended pending outcome of this application – Parish Council minute P10.47.9.

26.6.10 Chimney issue addressed in current application.
