<p>Objection: The noise, odours and late night opening hours associated with a tandoori takeaway 		could have a detrimental impact to the enjoyment of the residential properties surrounding the 		premises. Despite sophisticated venting and filtration systems, there will be inevitable odours 		adversely affecting nearby businesses. In addition outside smoking facilities used by staff and 		customers throughout the day and evening could create further noise and disturbance to 			residents.</p>

The Committee was very disappointed with the extremely low level of response to this consultation and is concerned that these results will not provide a correct reflection of the views of the general public. The Committee asked the Clerk to put this onto the Main Council Agenda for further discussion.</p>

<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.</p>
<p>22.06.09 Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09 Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09 District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.</p>
<p>23.11.09 Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.</p>

<p>The Local Development Framework – Core Strategy Public Consultation.  The consultation document can be found on the Chichester District Council’s website www.chichester.gov.uk.  The Committee voiced its concern that the consultation’s online questionnaire is very technical and therefore may be difficult for the general public to interpret which in turn may result in the conclusions drawn from the consultation not being an accurate reflection of the public’s views.  The public are encouraged to complete this questionnaire as this is the first in a set of documents that will shape future development in the District up to 2028.</p>

The Committee noted that this application was permitted by Chichester District Council Planning Committee. The Committee thanked Councillor Barrett for supporting the Parish Council’s objection to this application but expressed its concern and disappointment that there were a number of abstentions. The Clerk was asked to write to the District Council to ask why CDC is able to make decisions contrary to those decisions already made by the Planning Inspectorate.</p>

This proposed extension is now being 				referred to as an ‘extension’ rather than a ‘conservatory’. It appears that the 				applicant is gradually obtaining the initial extension that had been originally refused.</p>

<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.</p>
<p>22.06.09 Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09 Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09 District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.</p>

Comments are to be made through the website www.chichester.gov.uk or by telephone on 01243 534571.</p>

<p>The minutes of the meeting held on 13 June 2011 were confirmed as a correct record and signed by the Chairman.</p>

<p>P11.46 		Matters Arising     EWB/11/01459/COU  The Willows, Clayton Lane, Bracklesham.  The Council was asked to reconsider its decision and was given further information by way of Circular 01/2006 from CDC.  After discussion the Council agreed to continue to object and support the original decision by the Planning Inspector in May 2006 that ‘use herby permitted shall be carried out only by Mrs. Mitchell and her dependents and shall be for a limited period being the period during which the premises are occupied by the aforementioned persons’.  The Council noted that Circular 01/2006 was published on 2 February 2006 and therefore would have been available to the Inspector before he made his decision in May 2006.</p>

<p>Reason:  The Parish Council maintains its objection. This is a small private unmade residential cul de sac and is not suitable for this type of commercial development. There are no pavements and no turning areas so it is therefore unsuitable for any excess traffic.  There is no mention of waste disposal or methods of dealing with smells.</p>

<p>The minutes of the meeting held on 23 May 2011 were confirmed as a correct record and signed by the Chairman.</p>

<p>P11.39 	Matters Arising.</p>

<p>Application EWB/11/01459/COU – the Willows, Clayton Lane, Bracklesham.  Variation of conditions 1 and 2 Occupation of Site.</p>
<p>The Committee had requested a copy of Circular 01/2006 Gypsy and Travellers.  Unfortunately the Committee was unable to access the link provided and the hard copy had not arrived in time.</p>
<p>Proposed by Cllr. Breeze, seconded by Cllr. Lower the Committee remained concerned about altering the original Appeal decision which clearly states dependants only and therefore it confirmed its continued objection.  It will discuss the matter again when it has read Circular 01/2006 and any further information that supports such a change.  Although stated by Mr. Andrew Runciman that no further mobile homes will be permitted on this site according to the application form it seems clear the intention by the applicant is to provide accommodation for her daughter and new husband when they marry thereby extending the site.</p>

<p>P11.43.1 EWB/04/00367/CONCOM Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised building. (See history in previous minutes).</p>
<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.</p>
<p>22.06.09 Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09 Awaiting outcome of Crown Court hearing on 25.09.09.</p>

<p>12.01.10 Appeal upheld in part. Permission allowed for summer house. Appeal decision to be circulated to the Council.</p>
<p>25.2.10 Planning application received to demolish existing conservatory wings and new chimney stack (10/00938/DOM). Enforcement proceedings suspended pending outcome of this application – Parish Council minute P10.47.9.</p>
<p>26.6.10 Chimney issue addressed in current application. 19.7.10 No further update.</p>
<p>09.09.10 New Planning Application EWB/10/03605/DOM 04.10.10 Planning Application EWB/10/03605/FUL rejected by CDC Officers. 28.10.10 Building now being progressively returned to required standard. Enforcement team will be raising issue of untidiness of frontage of property. Parish Council requested a site visit to the rear of the property. 07.12.10 Ongoing. 7.2.11 Ongoing. 13.6.11  Appeal upheld by Planning Inspector.  Parish Council was dismayed by the result.  Case closed.</p>
