<p>Proposed 4 bed residential dwelling.</p>

<p>Resubmission of previously approved application EWB/10/00552/DOM to extend dwelling to north &#8211; east, alter roof and re-fenestration to entire dwelling.</p>

<p>The Committee OBJECTED to the following application:</p>

<p>P10.76.3	Amended planning application 10/02314/FUL for logging business at Longacre, Bracklesham Lane, Bracklesham.</p>
<p>Reasons:  Object to continuation of logging business at this location within the site.  Recommend moving it to NE boundary where there is no neighbouring property.  Request restriction to working and delivery hours: 9-5 Monday to Friday, 9-12 Saturdays and no Bank Holidays or Sundays.  Also look at ways of reducing noise by means of a sound reducing barrier fence.</p>
<p><br class="spacer_" /></p>
<p>Further to an email from CDC on 19.7.10 the Parish Council maintains its objection with further comment that it considers the business can be moved to NE boundary between pitch 2 and utility building as this completely avoids the power line as well as adjacent residential properties.  The southern boundary and the area NE of the workshop should remain an open space and not be used for residential or business purposes.</p>

<p>P10.78.1	   EWB/04/00367/CONCOM  Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised building. (See history in previous minutes).</p>
<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.</p>
<p>22.06.09  Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09  Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09  District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.</p>
<p>23.11.09  Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.</p>
<p>8.02.10 The appeal was dismissed.  If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.</p>
<p>01.03.10  The Applicant is applying to the High Court contesting Appeal decision.</p>

<p>30.6.08	Awaiting return of PCN.</p>
<p>13.10.08  PCN has been returned. The owner stated that the use of the mobile home is ancillary to the use of the dwelling. A requirement to remove fencing was made and a compliance check will be conducted by 23.10.08.</p>
<p>10.11.08  Compliance check carried out. Consideration now being given to enforcement action on usage of mobile home.</p>
<p>9.02.09 Enforcement Notice awaiting authorisation before issuing.</p>

<p>Replacement, repositioned detached garage.  Comment:  This garage is not to be used for living accommodation.</p>

<p>The Committee OBJECTED to the following application:</p>
<p>P10.69.10	EWB/10/02482/FUL  Driftwood Homes Ltd Land South Of 78 Stocks Lane EW</p>
<p>2 no. semi detached bungalows and associated works.</p>
<p><br class="spacer_" /></p>
<p>The Committee strongly OBJECT to this application for the following reasons:</p>
<p>The 2003 application for one bungalow was refused and the subsequent appeal was dismissed.  For this reason two bungalows should also be refused.</p>
<p><br class="spacer_" /></p>
<p>The presence of two detached bungalows within the existing garage compound would not be in keeping with the character of the area. The transfer of the existing garage building into a bungalow would result in a building with a character and appearance that is incongruous with the character and appearance of the garage compound.   The proposal would have an adverse effect upon the character of the area. This would conflict with the objectives of the relevant development plan policies.</p>
<p><br class="spacer_" /></p>
<p>The erection of fencing on the east boundary would be obtrusive to the residents of nos 74 and 76, which currently enjoy the relatively open landscape to the front gardens that was incorporated in the original design of the “estate”.</p>
<p><br class="spacer_" /></p>
<p>The lounge windows of the proposed bungalows would be immediately adjacent to the hard standing at the end of the compound. Because of this close relationship, the occupiers of the bungalows would experience an unacceptable amount of noise and disturbance from vehicles travelling along the access way through the compound, vehicles braking, vehicle doors slamming and garage doors being opened and closed.</p>
<p><br class="spacer_" /></p>
<p>The proposal would have an adverse effect upon the living conditions of the occupiers of the bungalow with particular reference to noise and disturbance and privacy.  This would conflict with the relevant policies of the development plan.</p>
<p><br class="spacer_" /></p>
<p>The applicants have drawn attention to PPS3 of the National Policy Guidance, in particular that the proposal would help to satisfy the objective of making more efficient use of land within urban areas to provide new housing.</p>
<p>The applicant has drawn attention to other aspects of the National Policy Guidance, namely PPS3, which states that the more efficient use of land is to take place without compromising the quality of the environment. It can be seen that the proposal would indeed compromise the quality of the environment.</p>
<p><br class="spacer_" /></p>
<p>Whilst appreciating that the application will be assessed against the policies of the Development Plan (SE Plan and Local Plan) it must be borne in mind that it is the Government’s intention to abolish the SE Plan.</p>
<p><br class="spacer_" /></p>

<p>P10.54		Matters Arising from the last meeting.  At Cllr. Lambert’s request the Clerk clarified the enforcement terms regarding the stables and caravans north of The Hawthorns, Bracklesham Lane.</p>

<p>P10.55	Public Questions.  Two members of the public raised concern over application no. EWB/10/00552/FUL, 6 Oakfield Avenue and that the Parish Council had not taken into account the objections from local residents.  Proposed by Cllr. Main, seconded by Cllr. Lambert the Committee agreed that if the District Council permits it will re-open this matter at its next meeting.</p>

<p>Reason:  Strongly object to access.  Inappropriate and dangerous to access adjacent to a bus stop on to the very busy Bracklesham Lane.  No objection to conversion.</p>

<p>P10.49.1	   EWB/04/00367/CONCOM  Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised building. (See history in previous minutes).</p>
<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. Awaiting CDC to advise on any further action.</p>
<p>22.06.09  Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09  Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09  District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced by the Court on appeal.</p>
<p>23.11.09  Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.</p>
<p>8.02.10 The appeal was dismissed.  If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.</p>
<p>01.03.10  The Applicant is applying to the High Court contesting Appeal decision.</p>

<p>13.10.08  PCN has been returned. The owner stated that the use of the mobile home is ancillary to the use of the dwelling. A requirement to remove fencing was made and a compliance check will be conducted by 23.10.08.</p>

<p>The Committee OBJECTED to the following application:</p>

<p>P10.38.4	EWB/10/00796/DOM  Mr And Mrs D Davies. 2 Claremont Gardens Solent Road EW. Extension to form new conservatory/garden room and location of 2 no. wind turbines.</p>
<p>Reason: The Parish Council objects as it has insufficient information about acceptable noise levels in the middle of such a quiet residential area.  The Council also has concerns over the noise levels affecting the wildlife.  The screening is from trees in neighbouring properties therefore cannot be guaranteed as the turbines are high. The Council encourages the use of alternative energy but feels that this proposal may not provide enough benefit to outweigh the disruption it could cause to those living nearby and would suggest that possibly solar panels would be more discreet.</p>

<p>P10.40.1	EWB/04/00367/CONCOM  Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised 	building. (See history in previous minutes).</p>
<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green 	fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. 	Awaiting CDC to advise on any further action.</p>
<p>22.06.09  Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09  Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09  District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced 	by the Court on appeal.</p>
<p>23.11.09  Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.</p>
<p>The appeal was dismissed.  If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.</p>
<p>01.03.10  The Applicant is applying to the High Court contesting Appeal decision.</p>

<p>P10.30.2	EWB/10/00858/DOM.  Mrs H K Fairbairn.  Somerswood House 144 Stocks 			Lane EW. Demolish existing single storey conservatories. Erect single storey 			side extensions with conservatory wings and new chimney stack.</p>
<p>Objection: The application is confusing – it appears there is no permission for 			the ‘L’ shape including the chimney and roof lights. The chimney is incongruous 			and out of keeping.</p>
<p><br class="spacer_" /></p>
<p>P10.30.3	EWB/10/00683/DOM  Mr Hamilton. 25 Oakfield Avenue EW. Proposed conservatory. Window to side elevation.</p>
<p>Objection: These comments are based on revision B on the website and not the original plan that was sent to the Committee in hard copy. The new window on the side elevation must have obscure glass and be non-opening as it overlooks the neighbour’s property which is not shown on the plan. Obscure glass, non-opening windows must also be on the conservatory adjacent to the neighbour’s on the west. There are also concerns that the conservatory will block out the light and a site visit is requested. If the conditions above are adopted, the Council will remove its objection.</p>

<p>The Committee OBJECTED to the following application:</p>

<p>P10.21.5	EWB/ 10/00378/FUL  Land At Os 9529 To The Rear Of Tanglewood Briar 		Avenue EW. Erection of replacement workshop. Objection:</p>
<p>The Council supports the neighbours’ concerns over the increased volume, size and subsequent noise from traffic accessing this site at all times. Due to the limited size of the access road, restrictions must be enforced on this development, as enlarging the property will increase business and therefore increase movements.</p>
<p>All conditions from WW/98/01026/ELD must be continued.</p>
<p>There should be no increase in the size of car transporter i.e. single vehicle carrier only.</p>
<p>The Council is concerned about the suitability of Briar Avenue for such commercial traffic as private cars already park on the road. For the benefit of the residents, we strongly recommend a redesign of the road i.e. widening of the road and provision of laybys.</p>
<p><br class="spacer_" /></p>
<p>P10.22	EWB/09/03909/OUT  Exors Of N C T Watford Dec&#8217;d.  Martlets Peerley Road EW. The Council was astounded by the comments made by the District Council. It was decided to take this item off the agenda until further developments.</p>
<p><br class="spacer_" /></p>
<p>P10.23 	EWB/09/07501/FUL.  Mrs Delia Brazil.  The Stables Bracklesham Lane Bracklesham. The use of land for the stationing of caravans for the residential purposes for 1 no. gypsy pitches together with the formation of additional hard standing and utility/ dayroom ancillary to that use as well as the retention of an existing stable block.</p>
<p>The Clerk is to represent the Council at the CDC Area Development Control Committee meeting on 3.03.10 at 10am.</p>

<p>P10.24	The Clerk provided an updated list of decisions regarding planning applications.</p>

<p>P10.25	Enforcement Enquiries – updates.</p>

<p>P10.25.1	EWB/04/00367/CONCOM  Stubcroft Farm, Stubcroft Lane, E. Wittering – unauthorised 	building. (See history in previous minutes).</p>
<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green 	fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. 	Awaiting CDC to advise on any further action.</p>
<p>22.06.09  Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09  Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09  District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced 	by the Court on appeal.</p>
<p>23.11.09  Awaiting outcome of appeal from Planning Inspectorate following the hearing into the refusal of planning applications.</p>
<p>The appeal was dismissed.  If compliance is not obtained voluntarily then CDC will consider obtaining an injunction that will request compliance.</p>
<p>01.03.10  The Applicant is applying to the High Court contesting Appeal decision.</p>

<p>P10.3	Matters Arising from the last meeting.     EWB/09/03909/OUT  Exors Of N C T Watford</p>
<p>Dec&#8217;d.  Martlets Peerley Road EW.   The Committee was very surprised and disappointed 		that Chichester District Council refused the application for 5 chalet bungalows on this site 		citing the reason that it was an inefficient use of the site and that 9 would be considered 		reasonable.  The Committee recognises that this is an unusual situation, as there are usually 		queries over too many houses being built on a plot, but is deeply concerned that Chichester 		District Council is able to insist that more houses are built.  The Committee felt that it is 		obvious no regard has been given to its comments and recommendations or those of 			Parishioners.  District Councillor Peter Clementson explained that this was Government 		guidelines but the Committee responded that guidelines and recommendations are not law 		and that Chichester 	District Council can apply them or disregard them where appropriate.</p>

<p>26.05.09 Chichester Magistrates Court passed the following sentences: Mr Green fined £4000 and ordered to pay costs of 348.27 and a victim surcharge of £15; Mrs. Green 	fined £1000 and ordered to pay costs of £1286.30 and a victim surcharge of £15. 	Awaiting CDC to advise on any further action.</p>
<p>22.06.09  Mr. Green appealing against the fine he has incurred. The subsequent applications that have been refused for the site have been appealed against and are awaiting a hearing date.</p>
<p>20.07.09  Awaiting outcome of Crown Court hearing on 25.09.09.</p>
<p>28.09.09  District Cllr Graeme Barrett reported that Mr. Green’s fine had been reduced 	by the Court on appeal.</p>

<p>The Committee had NO OBJECTION to the following applications:</p>

<p>P09.122.1	EWB/09/07469/DOM. Mr D Pether.  Sea Breezes 11 Tamarisk Walk EW. Single 			storey side extension.</p>
<p><br class="spacer_" /></p>
<p>The Committee OBJECTED to the following application:</p>
<p><br class="spacer_" /></p>
<p>P09.122.2	EWB/09/07501/FUL.  Mrs Delia Brazil.  The Stables Bracklesham Lane 				Bracklesham. The use of land for the stationing of caravans for the residential 			purposes for 1 no. gypsy pitches together with the formation of additional hard 			standing and utility/ dayroom 	ancillary to that use as well as the retention 	of an 			existing stable block.</p>
<p>Reason: This is agricultural land and not to be used for residential use. As far as the Council is aware, there has been no approval for a Change of Use for this land. The previous application (EWB/09/00321/FUL) for stables confirms the use of this land to be agricultural and the presence of the stables renders this land unsuitable for accommodation. The Council suggests that a site visit be carried out to clarify that the stables are not being used in association with habitation on the land.</p>
<p>The plans for this application are unclear. The Council is unable to decipher the black and white key. Has this been produced from a colour version? The Council is further concerned that the positioning of the stable block on the plans is inaccurate.</p>
<p>On the application form, question 3 asks if work has already started to which the answer is ‘No’. This is inaccurate. Question 18 on the same form asks if the proposal includes the gain or loss of residential units which has also been answered ‘No’. This is also inaccurate.</p>

<p>P09.123.1	EWB/09/03909/OUT  Exors of N C T Watford Dec’d. Martlets, Peerley Road, EW.</p>
<p>The Clerk was asked to write to the District Council expressing the Parish Council’s 		surprise and disappointment that this application has been refused. The Council 			realises that the District Council is following government guidelines concerning housing 		density but stresses that these are only guidelines. To increase the number of houses 		beyond five would be detrimental to the area.</p>

<p>P09.123.2	EWB/09/04247/NMA  Mr P Cook.  Bayscott Sussex Grove Bracklesham. The Chairman 		acknowledged the answer to his email concerning Bayscott and was happy with the 		decision.</p>

<p>P09.125		Enforcement Enquiries – updates.</p>

<p>Cllr. Lambert attended the public enquiry on 21 June 07 as representative of the Council and reported that the enquiry had received late paperwork from Mr. Green therefore the Planning Inspector decided to reconvene the enquiry on a date to be arranged in either August/September.  The Committee was advised that a new date has been set as 13/14 September.</p>
<p>10.9.07  Mr. Lambert confirmed that he would attend the public enquiry.</p>
<p>5.10.07 Inquiry held on 13,14 and 20 Sep 07 &#8211; awaiting decision from Planning Inspectorate (anything  between 4-10 weeks).</p>
<p>18.12.07  Committee advised that the decision can take up to a year.</p>
<p>21.1.08 Appeal dismissed. Enforcement notice EW/22 upheld, compliance by 4.4.08.</p>
<p>03.03.08 Awaiting compliance.</p>
<p>14.04.08  Compliance check carried out – building still in situ. Prosecution process 		commenced for non-compliance with enforcement notice.</p>
<p>10.06.08 Awaiting court date.</p>
<p>30.6.08  Court hearing 2.7.08.</p>
<p>28.7.08  Court allowed further time for applicant to submit planning application.  CDC 		awaiting application form.</p>
<p>18.08.08  Committee to ask why these were not dealt with as separate applications.</p>
<p>10.11.08  Committee asked the Clerk to write to Mr. Carvell (Head of Development and Building Control, CDC)  expressing its view that the judge’s recent decision to allow a planning application is questionable and undermines the decision of the Planning Inspector at the public enquiry. The Parish Council asks whether this decision is legitimate or whether CDC legal department can appeal against such a decision.</p>
<p>24.11.08  Application EWB/08/02786/FUL refused by CDC. Awaiting further information from CDC.</p>

<p>Court hearing on 20 February 2009. Defendants unsuccessful in their further request for an adjournment. Mr Green pleaded guilty. Mrs Green pleaded not guilty. Case adjourned until 30 April 2009.</p>
